Should Medical Marijuana Cards Be Considered in DUI Cases?
(Fall 2015) The Arizona Supreme Court will review a Court of Appeals ruling allowing drivers with medical marijuana cards to be charged with drugged driving if they test positive for marijuana. The lower court decided that medical marijuana cards cannot be used as a defense like prescription drugs are because medical marijuana is not prescribed by a physician only recommended. The case is anticipated to begin in September.
