Businesses are struggling to respond to Ohio’s new law legalizing the adult use of marijuana. At the same time, many organizations still haven’t taken a formal stand on Ohio’s medical marijuana law or federal laws regulating hemp-based products like CBD and Delta 8. And in May, the DEA proposed rescheduling marijuana from a Schedule I to Schedule III drug under the Controlled Substances Act. It’s a whirlwind.
Compounding the challenge for employers are the increasing rates of adult use of marijuana and positive drug tests, and the continuing workforce shortage. As a result, many employers are left wondering about whether — or how — to adjust their alcohol/drug policies and operations in an ever-changing environment:
- Should we stop testing job applicants?
- Should we drop marijuana from our drug testing panel?
- Should we accommodate employees who have a medical marijuana card?
- Maybe we should just ditch our drug-free workplace policy/program altogether?
